BALTIMORE (AP) – A Baltimore judge will allow certain parts of a civil lawsuit filed against the city’s top prosecutor and an assistant sheriff to proceed, but tossed other portions.
U.S. District Judge Marvin Garbis ruled that malicious prosecution, defamation and invasion of privacy claims brought by five of six officers charged in the death of Freddie Gray against State’s Attorney Marilyn Mosby and Assistant Sheriff Sam Cogen may move forward, but tossed claims of false arrest, false imprisonment and abuse of process.
Gray died April 19, 2015, a week after his neck was broken in the back of a police van. His death prompted massive protests, and the officers say Mosby prosecuted them in order to quell civil unrest.
Three were acquitted at trial, and Mosby dropped the remaining cases.
