(AURN News) — An off-duty Immigration and Customs Enforcement agent fatally shot Keith Porter Jr. on New Year’s Eve in Northridge, according to the Los Angeles Times.


Federal officials said the agent believed he was responding to an active shooter. Porter’s family and attorney dispute that account, saying Porter was firing a gun into the air to celebrate the new year and did not pose a threat.


Authorities said a rifle was recovered at the scene. Witnesses, however, said no law enforcement officer identified themselves before shots were fired.


The Los Angeles Police Department and the Los Angeles County district attorney’s office are investigating the shooting. Officials said a charging decision could take years.
The agent has not been publicly identified, and authorities said no body-camera or security footage exists.


Community members and activists have rejected the federal account, describing the killing as an overreaction.
